MONT BLANC'S GENERAL TERMS AND CONDITIONS FOR PURCHASE ONLINE

 

1           INTRODUCTION

These general terms and conditions for purchase online ("terms") govern the purchase of products ("products"), made by you ("you") as a consumer online at https://www.montblancgroup.com ("online"). A purchase agreement is entered into between you and SAS Mont Blanc France ("Mont Blanc", "we", "us"). The terms apply to all purchases you make online.

You must be at least 18 years old to purchase products online. You are responsible for ensuring that the personal information provided is accurate. Other terms or policies available on the website also apply to your online purchase, such as the Privacy policy at https://www.montblancgroup.com/en/privacy-policy. For online orders, we enter into agreements in Swedish.

Mont Blanc endeavors to ensure that all information online is up-to-date and accurate, but we cannot guarantee the absence of errors. We reserve the right to correct any incorrect information, prices, stock levels, descriptions, and to make such corrections.

2           FORMATION OF CONTRACT

To complete a purchase online, you must accept these terms and confirm that you have read the information on data processing.

The offers displayed online constitute a non-binding offer. You submit a binding offer to Mont Blanc by clicking the "Confirm Purchase and Pay" button at the end of the checkout process. By clicking this button, you commit to purchasing the products in your cart. A binding agreement is formed when you receive a written order confirmation from us at the email address you provided during the order. The order confirmation includes details about the order number, delivery date, and other specifics regarding the order. The order confirmation serves as a receipt for your order, and you are therefore encouraged to read and save it. In case of errors in the order confirmation, contact Mont Blanc immediately using the contact options found in section 11.

Ordering products online entails a payment obligation for the products.

3           PRICES

Prices online are stated in Swedish kronor (SEK) inclusive of VAT. Depending on the available delivery option, additional delivery costs may apply. Delivery costs are specified during the online ordering process. The total price is displayed in the final step of the ordering process before you place your order. The prices displayed online at the time of your order apply to your purchase. The prices are confirmed in the order confirmation.

4           PAYMENT

Payment options are shown at the beginning of the ordering process. You select the payment method at the end of the ordering process.

Through Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), the following payment options are offered online:

  • Pay now with Klarna - You pay for your purchase immediately at checkout, either by card or via a linked bank account.
  • Pay later with Klarna - You first receive your goods, can try them, and consider them before paying your invoice. You have the option to pay within 30 days.
  • Pay over time with Klarna - With installment payments, you can spread the cost of your purchase over up to 36 months.
  • Card - Mastercard, Visa, Maestro, or PayPal.

Additional costs and conditions may apply depending on the payment method you choose. To offer the above payment options, we need to transfer your personal data, contact information, and order information to Klarna and their potential subcontractors. 5           PROMOTIONS

Mont Blanc may periodically conduct promotions on all or parts of the range. These promotions apply during the period and under the conditions stated in connection with the promotion. Promotions cannot be combined with other discounts.

6           DELIVERY AND DELIVERY TIME

The delivery options available for your order are displayed online in connection with placing an order. More information about your delivery can be found here: Order and shipping.

The delivery cost for your order is specified directly in connection with your order and is also shown in the order confirmation. All delivery times are approximate and may change. In the event of delays, we will notify you as soon as possible with information about the delay.

7           TRANSPORT DAMAGE

Once you have received the Product, the goods should always be inspected for transport damage. Transport damage or missing goods must be reported immediately to Mont Blanc using the contact options found in section 11.

8           COMPLAINT

When you purchase a Product online, you have a three (3) year right of complaint according to Swedish law. This means that you can complain about defects in the Product that existed at the time of purchase but may appear later. Mont Blanc is not responsible for defects caused by misuse, accidents, or similar incidents. If you wish to invoke the right of complaint, contact us by email at support@montblancgroup.com, phone +46 33 22 27 00, or letter to Vevgatan 9, 504 64 Borås, Sweden, as soon as you discover the defect. The complaint must be made within a reasonable time after you noticed the defect or should have noticed it. If you complain within two months, you are considered to have complained within a reasonable time.

Upon receipt of your complaint, we will assess the Product based on current legislation. If the complained Product is found to be defective after such an assessment, we will compensate you in accordance with applicable consumer legislation. If the Product is found not to be defective, Mont Blanc reserves the right to deny the complaint.

Nothing in these terms excludes or in any way restricts the statutory rights that you have the right to assert.

9           WARRANTY

Certain products online are covered by warranties. The warranty entails that we will, at no cost, rectify defects in the Product that occur during the warranty period and are not due to normal wear and tear, accidents, misuse, or other external influences. The warranty period varies depending on the product type and is specified in the product description online. You can find more information at https://www.montblancgroup.com/en/about-us/support. To invoke the warranty, please contact Mont Blanc's support (see section 11). You need to provide your order number and describe the problem with the Product. Depending on the situation, we may ask you to send in the Product for review.

Please note that the warranty is a supplement to and does not limit or replace your statutory rights under consumer legislation, including the right of complaint, which gives you the right to complain about defective goods up to three (3) years after purchase.

10         RIGHT OF WITHDRAWAL

You have the right to withdraw from your purchase without providing any reason for it within 14 days. The withdrawal period expires 14 days after the day you or a third party on your behalf receives the Product you purchased from Mont Blanc.

You have the right to examine the characteristics, nature, and function of the Product, but please note that you must return the Product in its original condition. If you handle the Product more than necessary, Mont Blanc has the right to compensation for the decrease in value. In such a deduction, the Product's value upon return is compared with its original value at the time of purchase.

If you wish to exercise the right of withdrawal, you must send a clear and unambiguous message to Mont Blanc, Vevgatan 9, 504 64 Borås, Sweden, phone: +46 33 22 27 00, email: order@montblancgroup.com, indicating that you wish to exercise the right of withdrawal (e.g., a letter sent by post or email). You may use this Withdrawal form, but you are not required to use it.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this agreement, we will reimburse all payments received from you, including delivery costs (excluding any extra delivery costs resulting from your choice of a different delivery method than the cheapest standard delivery we offer). The reimbursement will be made without undue delay and in any event no later than 14 days from the day we were notified of your decision to withdraw from the purchase. We will use the same payment method for the reimbursement that you used for the payment unless you have expressly agreed otherwise with us. In any case, the reimbursement will not cost you anything. We may withhold the reimbursement until we have received the Product back from you or until you have provided evidence that you have returned the Product, whichever occurs first.

You shall return the Product to us without undue delay and in any case no later than 14 days from the day you informed us of your decision to withdraw from the agreement. The withdrawal period shall be deemed to have been observed if you return the products before this fourteen-day period has expired.

You will bear the direct costs of returning the Product. Bulky products require special transportation, which incurs a higher return cost, estimated to be a maximum of approximately 2,500 SEK.

12         PROCESSING OF PERSONAL DATA

Mont Blanc processes your personal data when you make a purchase in our online store, including name, delivery address, contact information, and payment information. The purpose of the processing is to manage your order, deliver your goods, and provide customer service. The processing of your personal data is necessary for the fulfillment of agreements due to your purchase and delivery of ordered goods.

13        AMENDMENT OF TERMS

Mont Blanc reserves the right to change these terms without prior notice. The terms available at https://www.montblancgroup.com at the time of your purchase govern your order.

14         GOVERNING LAW & DISPUTE RESOLUTION

These terms and the agreement between you and Mont Blanc are governed by and interpreted in accordance with Swedish law. Disputes arising from the terms or the agreement shall be resolved by the general courts in Sweden.

If you encounter issues with the delivered products and you and Mont Blanc cannot reach a resolution, you may submit your complaint to the National Board for Consumer Disputes, www.arn.se.
